What Lance Armstrong and Bernie Madoff Have in Common: via HuffPost http://huff.to/1021aIA I don’t see that they have anything in common. What I do see is a terrible precedent with Armstrong. He gets endlessly pursued in multiple forums until he gives up, although he’d been exonerated many times. So there is a double jeopardy issue there. Then he gets pressured to make a public admission, again after repeated prior exonerations. The principle of double jeopardy is almost as important as habeas corpus. The precedent this sets is that regulators aren’t subject to double jeopardy. They aren’t required to put their best case forward and then drop it and never raise it again if they fail. They can raise allegations against you or I and fail on them every time, but make the same allegations every year of our lives until we die or give up. How is that a victory? It isn’t about Armstrong, it’s about all of us. The rules changed for everybody to get one man.
