Black ops are supposed to stay black ops. 

Sometimes things have to be done out of bounds but it can never be official policy.

The CIA functioned just fine without institutional torture with the Bush administration, they probably functioned better.  They probably did it from time to time and the reason we didn’t hear about it was it wasn’t an institutional blank cheque.

Black ops keep the law pure.  Changing the law to make everything legal in the government’s discretion is the way to a banana republic.  Black ops also require real discretion.  The irony of giving government agencies formal discretion is that’s when they stop using it.
