What’s the point, if you negotiate it creates an incentive to get more hostages.

Also Bin Laden towards the end had concluded that targeting innocent civilians was a mistake, it tended to backfire with public opinion. 

The main thing to do is preventative, get better at keeping people away from risky situations.

Baiting traps could also be worthwhile, lure their kidnapping squads into ambushes.  If they use the same people that can be used for potential information.

That’s a class of people that I’d have no problem giving full service at Gitmo, or maybe in the field.

For some things, even “beyond a reasonable doubt” is too leaky a test, but when you get somebody caught in the field, armed and actually fighting on the side of a terrorist group, talk of doubt doesn’t make much sense.  

That is of course from the point of view of people in the field.  They also need to know that if they make something up as was done with Khadr, they will themselves suffer the full penalty of law.
