Hard to say what to think on the judge’s decision, not enough detail to say whether it was fair comment or not.  Sigh. 

Standard HP reporting.  If there a story about a pig flying, it would say just that, not how it was flying, or why it was flying, or where it was going, and it would be illustrated by a gallery of unrelated pictures of Kim Kardashian. Sigh.

Anyways, the good news is more prosecutors are willing to admit error and show some contrition.

This might be a case for more contrition.

Limitations may be out of time and in the US prosecutor privilege is near absolute, but that’s not a bar to giving him something because it’s right.

And in turn the law is a well deserved backlash over e.g. the bakery cases.

What’s needed, and nobody is talking about, is balance.

How to formulate that isn’t easy, but I’d suggest something like a distinction between passive and active involvement.

If you’re a burger joint, you aren’t participating in anything, just selling a burger. 
Baking a wedding cake or catering a wedding are active participation.

I can think of no rule more fundamental to democracy and human rights than to not participate in activities you don’t believe in.

Fundamentalists should no more be forced via government to participate in gay activities than gays should be forced to participate in fundamentalist ones, or blacks should be forced to cater for the KKK.

It’s a direct contravention of the first amendment and such restrictions should be struck down accordingly even without an express law in support.

If they want to deny something more basic like a burger or create a special section on the bus, then hammer them.

It’s our duty to leave each other alone, not to wank each other off.

So NSA got an opinion that what they were doing wasn’t legal and got an opinion from the justice department that a proposed fix wouldn’t save it, so they just kept illegally doing it.

In other words nothing short of Snowden was going to make them comply with the law.

The FBI has a duty to bring in everybody involved and charge them.

The FBI has its own precedent for that, the FBI deputy director that was the “Deepthroat” source for Watergate was with others convicted for aurthorizing break-ins to conduct illegal searches.  Same thing, same principle.

While ignorance of the law is no excuse, after the legal opinion it isn’t even a plausible mitigating factor, Alexander was certain what he was doing was illegal and kept doing it anyways.

They can convict and get 25 to life for a leader of one of the most powerful organized crime rings in the US with incontrovertable evidence, why the delay.

There’s something to that, but I’d go further than that.

Cooperate with the Koch brothers on reforming criminal justice.  Cooperate with libertarians on reducing military adventures and government spying.  Cooperate with the Vatican and Catholics on most social justice issues and eliminating poverty.

Liberals are losing in part because smug superiority is more important than winning. 

I would go further.  If you agree with somebody on 5% of issues that 5% should be half of what you talk about because that’s where the traction is, that’s where you can get his vote.

The attitude towards disagreement has to change.  Liberalism is an attitude, not a policy slate.  There are a lot of people out there who consider themselves liberal that aren’t.  If you are authoritarian you aren’t liberal.

If you are a true liberal, disagreement is not merely tolerated, disagreement is good. 

Even if the other guy is dead wrong, trying to shout somebody down is more likely to get him more entrenched than do anything useful. 

If you want to change somebody’s mind you have to get in his head, if you want to get inside his head you have to see how he thinks, if you want to see how he thinks you have to listen.  

Think, how would I have to see things for what he’s just said to make sense.

It also helps with the pitch to others.  Listening to even a weak argument the other way can help hone one’s arguments and understand how to frame it to win over people that are on the fence.

And every now and again, you will be wrong.

If you can’t entertain the possibility you are wrong, you aren’t a liberal, you’re a Sith Lord.
